Library Avenue Extension hits a snag – Buried in the Board of Supervisors’ consent agenda for this evening’s meeting is a request to begin the public hearing process necessary to use eminent domain to acquire a tiny (2,364 square feet) but critical piece of land needed to connect Library Avenue to Hilltop Street. 

It’s unclear whether this snafu will further delay Frank Stoner’s long-promised Downtown Crozet Plaza, which needs the Library Avenue connection to the eastern part of Crozet.

Without clear title to this parcel, the County can’t reasonably connect Library Ave to Hilltop St.

Given that the Library Avenue extension project is fully designed, funded, and serves a clear public use, the County may be qualified to use the power of eminent domain to acquire the right-of-way over this parcel.

That’s important because the parcel’s title is extremely “messy”. Unlike other open areas of the Parkside Village neighborhood, it was never transferred to the homeowners association (HOA) by its original developer, Vito Cetta. 

Instead, in July 2004, he sold it to Hauser Homes Inc according to County records. 

After also failing to deed the property to the Parkside Village HOA, Hauser Homes Inc went bankrupt, defaulted on its debts, and now has multiple judgments encumbering its remaining properties.

According to the County’s online tax records, it doesn’t appear that any real estate taxes were collected from the privately-owned property since 2006.

Ironically, Frank Stoner is listed as an officer of Hauser Homes Inc according to its 2004 Annual Report to the Virginia State Corporation Commission.
